These Terms & Conditions (the “Terms”) govern your access to and use of normanlamps.com (the “Site”) and your purchase of products from Norman Lamps, Inc. (“Norman Lamps,” “we,” “us,” or “our”). By using the Site or placing an order, you agree to these Terms. Please read them carefully. If you do not agree, please do not use the Site or place an order.

Use of This Site & Your Account

You agree to use the Site only for lawful purposes and in accordance with these Terms. If you create an account, you are responsible for keeping your login credentials confidential and for all activity that occurs under your account. You agree to provide accurate, current, and complete information and to keep it up to date. We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being used for fraudulent or unauthorized activity.

Products, Specifications & Availability

We work to describe our products accurately, but we do not warrant that product descriptions, images, specifications, pricing, or other content on the Site are complete, current, or error‑free. Product images are for illustration; actual items, colors, lumen output, and dimensions may vary, and manufacturers may change specifications without notice. All products are offered subject to availability, and we may limit quantities, discontinue products, or correct errors at any time without prior notice.

Pricing & Order Acceptance

Prices are shown in U.S. dollars and are subject to change without notice. Despite our best efforts, a product may occasionally be listed at an incorrect price or with incorrect information due to a typographical or system error. In that event, we reserve the right to cancel or refuse any order placed for that product, even after an order confirmation has been sent.

Your submission of an order is an offer to purchase. All orders are subject to our acceptance, and a confirmation email acknowledges receipt of your order but does not constitute acceptance. We reserve the right to refuse, limit, or cancel any order for any reason, including suspected fraud, pricing or product errors, or product unavailability. If we cancel an order after payment has been processed, we will issue a refund for the cancelled items.

Payment & Taxes

We accept the payment methods presented at checkout, which may include major credit and debit cards (processed through Authorize.Net), PayPal, and other options we may offer from time to time. By submitting payment information, you represent that you are authorized to use the payment method. Applicable sales tax is calculated and added at checkout based on your shipping destination and the nature of the products. If you are a tax‑exempt or reseller account, please contact us with your exemption documentation before ordering.

Shipping & Delivery

Shipping options, processing times, rates, local pickup, and carrier information are described on our Delivery Information page. Delivery time estimates are not guaranteed, and we are not responsible for delays caused by carriers, weather, customs, or events beyond our control. Title and risk of loss for products pass to you upon delivery to the carrier. Please inspect your shipment promptly upon receipt and report any visible damage or shortage to us and the carrier right away.

Returns & Refunds

All returns must include an RGA (Return Goods Authorization) provided by Norman Lamps with an assigned RGA number. If a return is received without a valid RGA, it will be refused and returned to sender. To obtain an RGA, please contact us.

Defective merchandise. Full refunds are provided for truly defective merchandise only, within 30 days of receipt. Examples include, but are not limited to, products damaged beyond repair or products that will not turn on.

Non‑defective merchandise. All other orders deemed non‑defective, within 30 days of receipt, are subject to a 15% restocking fee, with all shipping charges being non‑refundable. If you use a pre‑paid label and the items are tested to be non‑defective, the label postage cost will be deducted from the refund; for low‑cost orders this may lead to little or no refund. Examples of non‑defective merchandise include, but are not limited to: color matching, lumen output, dimming capability, product dimensions, tampering, overvolting, product misuse or abuse, light flickering, fitment issues, and incompatibilities with fixtures, dimmers, transformers, ballasts, or specific applications.

All claims of issues, defects, or incompatibilities must be verified at a Norman Lamps, Inc. facility before a refund will be provided. By starting the return process, you agree to these Terms.

Upon arrival, credit will be issued promptly. Norman Lamps is not responsible for returned shipments sent to an incorrect address. We strongly recommend insuring your returned shipment, as refunds will not be offered for items lost or damaged in return transit.

Product Use, Installation & Safety

Our products are electrical lighting components intended for use by knowledgeable purchasers and, where appropriate, qualified professionals. You are responsible for selecting products suitable for your application and for installing and operating them safely and in accordance with the manufacturer's instructions, the product ratings, and all applicable electrical and building codes. Improper selection, installation, voltage, handling, or use may damage the product, void any warranty, and create a safety hazard. If you are unsure whether a product is right for your application, please contact us before ordering.

Warranties & Disclaimer

Many products are covered by the original manufacturer's warranty, if any; warranty terms, duration, and remedies are set by the manufacturer. To the fullest extent permitted by law, and except as expressly stated in writing by us or required by applicable law, products and the Site are provided “as is” and “as available,” and we disclaim all other warranties, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non‑infringement. No advice or information you obtain from us creates any warranty not expressly stated in these Terms.

Limitation of Liability

To the fullest extent permitted by law, Norman Lamps and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or use, arising out of or related to your use of the Site or any product purchased from us, whether based in contract, tort, or any other legal theory, even if advised of the possibility of such damages. To the extent liability cannot be excluded, our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless Norman Lamps and its officers, employees, and suppliers from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms, your misuse of the Site or products, or your violation of any law or the rights of a third party.

Intellectual Property

The Site and its content — including text, graphics, logos, images, and the Norman Lamps name and marks — are owned by or licensed to Norman Lamps, Inc. and are protected by intellectual‑property laws. You may not copy, reproduce, distribute, or create derivative works from Site content without our prior written permission. Other product names, brands, and trademarks are the property of their respective owners and are used for identification only.

Third‑Party Links & Privacy

The Site may contain links to third‑party websites or services that we do not control and are not responsible for. Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and share your information.

Governing Law & Disputes

These Terms and any dispute arising out of or relating to them or your use of the Site are governed by the laws of the State of Illinois, without regard to its conflict‑of‑laws rules. You agree that the exclusive venue for any dispute that is not otherwise resolved will be the state or federal courts located in or serving Kane County, Illinois, and you consent to the jurisdiction of those courts.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Effective date” above and post the updated Terms on this page. Your continued use of the Site or placement of an order after changes take effect constitutes your acceptance of the updated Terms.

General

These Terms, together with our Privacy Policy and any order confirmation, constitute the entire agreement between you and Norman Lamps regarding your use of the Site and your purchases. If any provision is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver of that provision. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
